These Terms of Use (“Terms of Use”), effective as of the date stated above, govern your access to and use of the website located at https:www.driveobi.com and any related DriveObi social media channel, website, application, feature, widget, or other online service that is owned or controlled by DriveObi (and their mobile counterparts) that posts a link to and indicates that these Terms of Use govern (collectively, including our rideshare application (our “Application”), our “Services”) but expressly excluding any DriveObi Services that state that they are offered under different terms of use or service.

PLEASE READ THESE TERMS CAREFULLY. THEY CONTAIN A MANDATORY ARBITRATION AGREEMENT AND A WAIVER OF CLASS ACTION RIGHTS.

OBI DOES NOT PROVIDE TRANSPORTATION SERVICES. ALL SERVICES ARE PROVIDED BY THIRD-PARTY PROVIDERS.

You are responsible for maintaining the confidentiality of your account and all activity under it.

User Conduct

Use the Services only for lawful purposes
Do not interfere with system integrity
Do not transmit malware or harmful code
Do not resell or distribute Services

License Grant

DriveObi grants you a limited, non-exclusive, non-transferable license for personal, non-commercial use.

Copyright Policy

DriveObi respects intellectual property rights and responds to valid infringement notices.

Payment Terms

All fees are non-refundable. Pricing may change at any time.

Third-Party Services

DriveObi is not responsible for third-party services or pricing accuracy.

Indemnification

You agree to indemnify and hold DriveObi harmless from claims arising from your use of the Services.

THE SERVICES ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.

Limitation of Liability

DriveObi shall not be liable for indirect, incidental, or consequential damages.

Arbitration Agreement

ALL DISPUTES MUST BE RESOLVED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS.

Governing Law & Jurisdiction

Courts located in New York County, New York shall have jurisdiction where arbitration does not apply.
